Capacity building seminar on issues relating to constitutional and referendum disputes

Cour Suprême : Dans le cadre de la promotion de la démocratie et de l’État de droit, un Séminaire de renforcement de capacités sur les questions relatives aux contentieux constitutionnel et référendaire started this Monday, June 24, 2024 in a hotel reception (White House, Coyah prefecture, located 50 kilometers from Conakry, bringing together magistrates, clerks, and other members of the Supreme Court and surrounding jurisdictions.

This four-day seminar took place from June 24 to 27, 2024 under the aegis of the Supreme Court, with the support of ECES-PARD funded by the European Union, in partnership with the International Organization of La Francophonie.

During these four days, several questions were debated, namely:

• Les Objectifs et méthodologie de l’atelier ;
• La Séance de Team Building ;
• Le contrôle de constitutionnalité des lois : approche générale ;
• Le contrôle de constitutionnalité a priori ;
• Le contrôle de constitutionnalité a posteriori des lois ;
• Le contrôle de constitutionnalité des conventions ;
• Le contrôle de constitutionnalité des lois de révision constitutionnelle ;
• Les méthodes de raisonnement et les techniques de contrôle de constitutionnalité ;
• Les compétences consultatives du juge constitutionnel ;
• La motivation des décisions du juge constitutionnel ;
• L’autorité de la chose jugée : les effets et l’exécution des décisions du juge constitutionnel ;
• Le juge constitutionnel et la communication ;
• The sources of electoral law;
• Les principes généraux du droit électoral ;
• Les opérations et les contentieux référendaires ;
• Le contentieux de constitutionnalité des décisions de justice ;

Expected Results

At the conclusion of the seminar, participants were better equipped to address the complex challenges related to constitutional and referendum litigation in their respective contexts. The main expected results are, among others:

• Une meilleure compréhension des principes juridiques ; fondamentaux régissant les référendums et les contentieux constitutionnels ;
• Le renforcement des compétences analytiques et décisionnelles nécessaires pour traiter efficacement les litiges de nature constitutionnelle ;
• A strengthened network of professionals and experts committed to promoting democracy and the rule of law around the world.

This capacity building seminar on issues relating to constitutional and referendum disputes was a remarkable success. It not only enriched the knowledge of the participants, but also stimulated a constructive and inter-institutional dialogue essential for the promotion of good governance and constitutional justice. This seminar marks an important step towards a better understanding and reinforced application of fundamental democratic principles throughout the world and particularly in the Republic of Guinea.
